You commit Vehicular Assault when you cause death or serious bodily injury to another while using a ‘propelled vehicle’ a/k/a car and the unlawful operation of the car materially contributes to the collision. Evidence that you violated any rules of the road is “prima facie” evidence that you caused or materially contributed to the collision.
Vehicular Assault is a Class A Misdemeanor punishable by up to a year in the House of Correction and a $2,000 fine. You can expect to hear from the DMV following a conviction. A conviction for Vehicular Assault qualifies as a “major” motor vehicle conviction towards certification as a Habitual Offender.
